Council Meeting

THAT the draft agenda presented to Council and dated the 14th day of May, 2019 be hereby adopted as circulated.

THAT the minutes of the Special Meeting held April 23rd and the Regular Meeting held April 23rd, 2019 be adopted as circulated.

THAT Council of the Municipality of East Ferris accepts the recommendation from the Manager of Planning and Economic Development in Report No. PLANN-2019-002 to sell the unopened road allowance to the adjacent owners of 1778 Village Road, Marnie and Jerry Labrecque, in accordance with the cost laid out in the Fees and Charges By-law and that the total sale price be $2400.00; AND FURTHER that all additional costs related to surveying, legal fees, or any other costs associated with the transfer will be paid by the purchaser.

THAT Council of the Municipality of East Ferris accepts the recommendation from the Municipal Engineer contained in Report No. R-2019-01 and that Request for Quotes EF-2019-01 for the supply and application of dust control and road stabilization materials be awarded to Pollard Hwy Products in the amount of $112,958.19 including H.S.T.

THAT Council for the Municipality of East Ferris accepts the recommendation from the Municipal Engineer contained in Report No. R-2019-02 and that the Request for Quotes EF-2019-02 for equipment rental be accepted and that the use of equipment be based on the attached reference table.

That Council of the Municipality of East Ferris accepts the recommendation from the Municipal Engineer contained in Report No. R-2019-03 and that Tender EF-2019-03 for Winter Sand in the amount of $53,901.00 including H.S.T. be awarded to Miller Paving North Bay for 2019.

THAT Council of the Municipality of East Ferris accepts the recommendation from the Municipal Engineer contained in Report No. R-2019-04 and that EF-2019-04 for granular materials in the amount of $187,139.30 including H.S.T. be awarded to Evan Hughes Excavating for the 2019 construction season.

THAT Council of the Municipality of East Ferris accepts the recommendation from the Municipal Engineer contained in Report No. R-2019-05 and that Request for Proposal EF-2019-05 for one (1) new Diesel Tandem Sander Plow Truck in the amount of $294,196.63 (including H.S.T.) be awarded to Freightliner North Bay.

THAT Council of the Municipality of East Ferris accepts the recommendation from the Municipal Engineer contained in Report No. R-2019-06 and award RFQ EF-2019-06 to Hopper Buick GMC for a new 2019 GMC Sierra 3500 HD series in the amount of $49,170.30 (H.S.T. included).

THAT Council of the Municipality of East Ferris accepts the recommendation from the Municipal Engineer contained in Report No. R-2019-07 as follows: 1. That the Director of Public Works be authorized to order a used 850C John Deere Dozer at a cost of $38,500.00 (plus applicable taxes); and 2. That Kent Farm Supplies Limited of Chatham-Kent, Ontario be designated as sole source provider for the purchase of the 1999 850C John Deere Dozer; and 3. That the total price includes the float delivery F.O.B. Corbeil.

THAT Council of the Municipality of East Ferris accepts the recommendation from the Municipal Engineer contained in Report No. R-2019-08 as follows: 1. That Council endorse the Final Acceptance Certificate for Treadlightly Subdivision - Phase 2 Plan of Subdivision (Plan M-522); and the full release to the Owner of the letter of guarantee security deposit; 2. That Council pass a by-law assuming the entirety of Treadlightly Drive pursuant to s.31(4) of the Municipal Act; 3. That upon the passing of such a By-law, the ownership of the entirety of Treadlightly Drive services within the existing Road Allowance as set out in Plan M-522 shall rest with the Municipality; furthermore that its regular and winter maintenance, garbage and recycling services shall become the responsibility of the Municipality.

THAT Council of the Municipality of East Ferris accepts the Information Report No. R-2019-09 from the Municipal Engineer regarding the proposed stop sign - Big Moose Road Westerly before Guillemette Road Intersection.

WHEREAS Council for the Municipality of East Ferris deems it expedient to pass three readings of the following By-law at this session; BE IT HEREBY RESOLVED THAT By-law 2019-18 to implement Official Plan Amendment No. OPA-2018-02, (185477 Ontario Inc.) BE READ a first, second and third time, passed and numbered 2019-18; AND THAT said By-law be signed by the Mayor and Clerk and sealed with the Seal of the Corporation.

WHEREAS Council for the Municipality of East Ferris deems it expedient to pass three readings of the following By-law at this session; BE IT HEREBY RESOLVED THAT a By-law to amend By-law No. 1284 as amended (185477 Ontario Inc.), BE READ a first, second and third time, passed and numbered 2019-19; AND THAT said By-law be signed by the Mayor and Clerk and sealed with the Seal of the Corporation.

WHEREAS Council for the Municipality of East Ferris deems it expedient to pass three readings of the following By-law at this session; BE IT HEREBY RESOLVED that a By-law to authorize a lease agreement between the Municipality of East Ferris and Her Majesty the Queen in Right of Ontario as Represented by the Minister of Government and Consumer Services for property known as 1990 Corbeil Road, BE READ a first, second and third time, passed and numbered 2019-20; AND THAT said By-law be signed by the Mayor and Clerk and sealed with the Seal of the Corporation.

THAT Council acknowledge the correspondence as circulated with the agenda and dated the 14th of May, 2019.

WHEREAS a presentation from Mr. Glenn Brophey and Mr. Mike Pettigrew was made at the Regular Council meeting held April 23rd, 2019 requesting Council direct staff to provide a report of One Mile Road pertaining to the work required to upgrade all of the road to standards and to deliver services for the existing One Mile Road property owners; BE IT HEREBY RESOLVED that Council refer Mr. Brophey's presentation and Mr. Mike Pettigrew's letter to the Public Works Committee meeting to be held May 21st, 2019; AND FURTHER that a report be prepared by the Director of Public Works for the next regular scheduled Council Meeting to be held May 28th, 2019 for recommendation.

WHEREAS the Council for the Municipality of East Ferris passed the 2019 Capital Budget on April 23 rd , 2019 in the amount of $7,790,513.00; AND WHEREAS funds for several approved road construction projects were not included in the total 2019 Capital Budget figure; BE IT HEREBY RESOLVED that the Groulx Road patch repairs project in the amount of $90,000, and the Lake Nosbonsing Road and Village Road patch repairs project in the amount of $245,000 be added to the 2019 Capital Budget program for a total 2019 Capital Budget of $8,125,513.00; AND FURTHER that Federal Gas Tax Funding be utilized to fund these additional road projects.

THAT Council approve the general accounts for the Municipality of East Ferris as indicated in the cheque register(s) dated May 14th, 2019 in the amount of $468,801.25.

WHEREAS Council for the Municipality of East Ferris deems it expedient to pass three readings of the following By-law at this session; BE IT HEREBY RESOLVED THAT a By-law to confirm the proceedings of Council from April 23rd, 2019 to May 14th, 2019, BE READ a first, second and third time, passed and numbered 2019-17; AND THAT said By-law be signed by the Mayor and Clerk and sealed with the Seal of the Corporation.
