Council Meeting

THAT the draft agenda presented to Council and dated the 28th day of May, 2019 be hereby adopted as circulated.

THAT the minutes of the Regular Meeting of Council held May 14th, 2019 be adopted as circulated.

WHEREAS no public input was received during the public meeting for Consent Application B-2019-05 at the Planning Advisory Committee held on May 15 th , 2019; AND WHEREAS the Planning Advisory Committee is of the opinion that the proposal is consistent with Provincial Policy, the Municipality’s Official Plan, the Zoning By-law and represents good land use planning; BE IT HEREBY RESOLVED that the Council of the Municipality of East Ferris concurs with Resolution No. 2019-03 passed by the Planning Advisory Committee at their meeting held May 15 th , 2019 and approves Consent Application No. B-2019-05 (Michel Lavigne) for the property described as 613 Lavigne Road (Part of Lots 7 & 8, Concession 9), to sever a parcel of land for the purpose of a lot addition to the adjacent property at 647 Lavigne Road; together with those conditions as set out in the Planning Advisory Committee Resolution dated May 15 th , 2019.

WHEREAS no public input was received during the public meeting for Consent Application B-2019-06 at the Planning Advisory Committee held May 15 th , 2019; AND WHEREAS the Planning Advisory Committee is of the opinion that the proposal is consistent with Provincial Policy, the Municipality’s Official Plan, the Zoning By-law and represents good land use planning; BE IT HEREBY RESOLVED that the Council of the Municipality of East Ferris concurs with Resolution No. 2019-04 passed by the Planning Advisory Committee at their meeting held May 15 th , 2019 and approves Consent Application No. B-2019-06 (Ron Lavigne on behalf of Dan Power) for the property described as 42 Lavigne Road (Lot 13 and Part of Lot 14, Concession 10) to sever a parcel of land with approximately 100 metres of frontage on Lavigne Road and an area of 1 hectares for the purpose of creating one new residential lot; together with those conditions as set out in the Planning Advisory Committee Resolution dated May 15 th , 2019.

WHEREAS no public input was received during the public meeting for Consent Application B-2019-07 at the Planning Advisory Committee held May 15th, 2019; AND WHEREAS the Planning Advisory committee is of the opinion that the proposal is consistent with Provincial Policy, the Municipality's Official Plan, the Zoning By-law and represents good land use planning; BE IT HEREBY RESOLVED that the Council of the Municipality of East Ferris concurs with Resolution No. 2019-05 passed by the Planning Advisory Committee at their meeting of May 15th, 2019 and approves consent Application No. B-2019-07 (Ron Cooke) for the property described as 41 Northwoods Drive (Part of Lot 11, Concession 3, Part 15, Plan NR-5) to sever a parcel of land for the purpose of a lot addition to the adjacent property at 55 Northwoods Drive together with those conditions as set out in the Planning Advisory Committee Resolution dated May 15th, 2019.

WHEREAS the Planning Advisory Committee has recommended to Council that in order to correct a municipal error made in 2006 pertaining to Consent Application File B-2019-07, where the road allowance in front of 55 Northwoods drive was mistakenly merged with 41 Northwoods Drive; AND WHEREAS the applicant is seeing consent in order to remedy the issue; BE IT HEREBY RESOLVED that Council approves of the recommendation made by the Planning Advisory Committee under their resolution No. 2019-06 and approve that all legal fees associated with this land transfer for File B-2019-07 be borne by the municipality; AND FURTHER that Mr. Cook be advised accordingly.

WHEREAS public input was received and considered at the public meeting of the Planning Advisory Committee Meeting held May 15th , 2019 regarding Files No. SB-2018-03 and C-2018-03, Applicant Nosbonsing Park Limited; AND WHEREAS the owner(s) of the lands described as Part Borken Lot 5 and Part Original Road Allowance in front of Broken Lot 5, Concession 5, Township of East Ferris, District of Nipissing on what is locally known as Nosbonsing Park Road has applied for a draft plan of subdivision and Zoning By-law Amendment for the purpose of creating a new 8 lot, waterfront residential development; AND WHEREAS the application has regard for the criteria of Section 51(24) of the Planning Act ; AND WHEREAS the application is consistent with the Provincial Policy Statement 2014; AND WHEREAS the application is in conformity with the policies contained within the Official Plan for the Municipality; BE IT HEREBY RESOLVED that Council approves of the recommendation of the Planning Advisory Committee together with those conditions as set out in their resolution No. 2019-07 dated May 15th, 2019.

THAT Council for the Municipality of East Ferris accepts the recommendation from the Manager of Recreation and Facilities contained in Report No. PR-2019-01 and approve the purchase of an ice re-surfacer from Zamboni Company Inc. at a total cost of $89,558.15 including HST (municipal costs including HST credit $79,225.00).

WHEREAS Council for the Municipality of East Ferris deems it expedient to pass three readings of the following By-law at this session; BE IT HEREBY RESOLVED THAT a By-law to accept and include into the Municipal Road System of the Municipality of East Ferris the Remainder of Treadlightly Drive as shown on Plan M-522, BE READ a first, second and third time, passed and numbered 2019-21; AND THAT said By-law be signed by the Mayor and Clerk and sealed with the Seal of the Corporation.

THAT By-law No. 2019-22 being a By-law to establish fees and charges for services or use of Municipal Property be read a first and second time this 28 th day of May, 2019.

THAT Council acknowledge the correspondence as circulated with the agenda and dated the 28th of May, 2019.

THAT the Municipality of East Ferris support resolution No. COW 2019-069 passed by the Town of Minto regarding the concern with the potential reduction and/or loss of the OMPF allotment in future years.

WHEREAS at the Regular meeting of Council held May 14th, 2019, Council requested that the Municipality of East Ferris petition Ontario Municipalities to support the OGRA/ROMA Combined Conference; AND WHEREAS the Municipality has received already same request from the Town of Petrolia to support a combined conference; BE IT HEREBY RESOLVED that this resolution be circulated to all Ontario Municipalities and petition ROMA to place the combined conference to a membership vote.

THAT Council of the Municipality approved a Canada Day Budget up to a maximum of $ 1,500.00.

WHEREAS discussions have been taking place with various Municipal Committees to establish a clean up day in the Municipality of East Ferris; AND WHEREAS Council has selected Saturday, June 15th, 2019 as the Clean Up Day in the Municipality; BE IT HEREBY RESOLVED that Council direct staff to organize and promote the event.

THAT Council approve the general accounts for the Municipality of East Ferris as indicated in the cheque register(s) dated May 28th, 2019 in the amount of $240,807.13.

WHEREAS Council for the Municipality of East Ferris deems it expedient to pass three readings of the following By-law at this session; BE IT HEREBY RESOLVED THAT a By-law to confirm the proceedings of Council from May 14th, 2019 to May 28th, 2019, BE READ a first, second and third time, passed and numbered 2019-23; AND THAT said By-law be signed by the Mayor and Clerk and sealed with the Seal of the Corporation.
